Terms of Service

These Terms of Service ("Terms") govern your use of the SMS-based maintenance request service ("Service") provided by Public Source LLC ("we," "us," or "our"). By using the Service, you agree to these Terms.
1. Service Description
Our Service allows tenants to submit maintenance requests via SMS and MMS. You can text descriptions and photos of maintenance issues, which are processed and forwarded to your property manager for resolution.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age.
- Be a tenant at a property enrolled in our Service by your property manager.
- Have a valid mobile phone number capable of sending SMS/MMS messages.
3. Acceptable Use
When using the Service, you agree to:
- Provide accurate and truthful information about maintenance issues.
- Only submit photos of actual maintenance problems in your rental unit.
- Not use the Service for emergencies requiring immediate assistance (call 911 for emergencies).
- Not send abusive, threatening, or inappropriate content.
- Not attempt to misuse or disrupt the Service.
4. Emergency Situations
Important: This Service is not for emergencies. If you have an emergency such as a fire, gas leak, flooding, or any situation that poses immediate danger to life or property, call 911 or your local emergency services immediately. After addressing the emergency, you may use this Service to report the issue for follow-up.
5. AI-Assisted Processing
Our Service uses artificial intelligence to analyze your submissions and assist with triage. You understand that:
- AI analysis is provided to assist property managers, not replace their judgment.
- AI-generated severity assessments and categorizations may not always be accurate.
- Final decisions about maintenance responses are made by your property manager.
6. SMS Consent and Opt-In
By sending an SMS or MMS message to our service phone number, you consent to receive SMS and MMS replies from Public Source LLC related to your maintenance requests. This is an opt-in service — all conversations are initiated by you, the tenant. We do not send unsolicited or promotional messages.
- Opt-in: You opt in by texting our service number to start a conversation.
- Opt-out: Text STOP at any time to stop receiving messages. You will receive a one-time confirmation of your opt-out.
- Help: Text HELP for assistance.
- Message frequency: Varies based on your maintenance requests. Messages are only sent in reply to conversations you start.
- Message and data rates: Standard message and data rates from your mobile carrier may apply. We are not responsible for any charges incurred from your carrier.
7. No Guarantee of Response Time
While our Service facilitates the submission of maintenance requests, we do not guarantee any specific response or repair time. Response times are determined by your property manager based on the nature and severity of the issue.
8. Content You Submit
By submitting content (text and photos) to the Service, you:
- Grant us permission to store, process, and share your content as described in our Privacy Policy.
- Confirm that you have the right to submit such content.
- Understand that submitted content will be shared with your property manager and potentially maintenance contractors.
9. Service Availability
We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
10. Limitation of Liability
To the fullest extent permitted by law:
- The Service is provided "as is" without warranties of any kind.
- We are not liable for any damages arising from your use of the Service.
- We are not responsible for any property damage, personal injury, or other losses resulting from maintenance issues or delays in addressing them.
- We are not a party to any lease agreement or landlord-tenant relationship.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or at the direction of your property manager. Your property manager may also remove your access to the Service.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
